Privacy & Terms of Service
FiHosts terms and privacy policy · cross-border working draft
The legal entity, refund policy, dispute forum, and actual data-processing details require confirmation. Do not enable mandatory checkout acceptance until reviewed.
Terms of Service
01 Contracting Entity and Scope
These Terms cover dedicated servers, virtual servers, cloud resources, network protection, and other hosting-related services expressly offered through FiHosts. Product specifications, locations, prices, term, bandwidth, protection features, and service levels are governed by the order information presented and accepted at checkout, together with any separately executed agreement.
Provider's full legal entity name, place of incorporation, and business contact address: [TO BE VERIFIED]. Until this information is confirmed and published, this document is a draft for internal review only and should not be treated as a finalized customer contract.
Customers represent that they order on their own behalf or with authority for an organization and will maintain accurate contact details. Material service notices may be delivered through the client area or registered email.
02 Orders, Acceptance, and Provisioning
Submitting an order does not guarantee its acceptance. FiHosts may conduct proportionate payment, availability, fraud, security, sanctions, or other lawful compliance checks before accepting, rejecting, or requesting further verification of an order.
Estimated provisioning times are those disclosed on the product and order pages. If ordered resources cannot be supplied, FiHosts will promptly inform the customer and address payments for undelivered services in accordance with applicable law and the agreed order terms.
IP addresses, facility assignments, and routes may change for reasonable maintenance, resource-management, or legal reasons. Material changes to the core service should be disclosed in advance where practicable, except for emergencies or binding legal requirements.
03 Prices, Invoices, and Renewals
Applicable prices, taxes, initial charges, recurring charges, setup fees, and other known costs must be clearly presented before confirmation. Customers must pay invoices in the stated currency and by the stated due date.
Any recurring card charge or automatic renewal must be clearly explained, including its billing frequency, affirmative authorization, cancellation method, and financial consequences. No new recurring charges should be imposed without valid authorization. Stopping service renewal and revoking a payment mandate may involve separate steps, which must be clearly disclosed.
Overdue invoices may result in notices, suspension, or termination only subject to the disclosed terms and applicable law. Data retention and deletion are governed by the data provisions and mandatory legal duties.
04 Cancellation, Refunds, and Billing Disputes
Refund eligibility depends on applicable law, product-specific terms disclosed before purchase, and actual service performance. No blanket 'no refunds under any circumstances' clause overrides mandatory consumer rights or legal remedies.
Where FiHosts cannot provide a paid service, materially fails to deliver an agreed service, or a refund is otherwise legally required, payments will be addressed under applicable law and the agreement. Treatment of unused prepaid time depends on the disclosed cancellation policy, product, and mandatory law.
Customers may submit tickets for duplicate charges, billing errors, or disputed payments. FiHosts will investigate within a reasonable time and explain the outcome. Lawful claims and remedies cannot be waived through a unilateral statement.
05 Acceptable Use Policy (AUP)
Customers must not use services for unlawful intrusion, DDoS attacks, botnets, malware, phishing, fraud, unsolicited bulk messaging, or unauthorized acquisition of information.
Customers must not unlawfully distribute prohibited content or infringe intellectual property or privacy rights. Content legality depends on the applicable jurisdiction and actual facts; unverified complaints alone should not automatically trigger permanent penalties.
Activities that materially threaten network integrity or other customers, including abusive scanning, malicious overload, spoofing, and circumvention of reasonable security controls, are prohibited. Security testing requires lawful authorization from the target owner.
For substantiated serious abuse, FiHosts may take lawful, necessary, and proportionate actions such as rate limits, isolation, or temporary suspension. Notice and an appeal path should generally be provided, except when immediate action is needed to mitigate imminent harm.
06 Network Quality, Mitigation, and Availability
Connectivity, latency, packet loss, and DDoS-mitigation effectiveness vary with geography, upstream networks, attack types, and traffic volumes. Only metrics expressly promised in an order or applicable SLA constitute contractual service-level commitments.
FiHosts will use reasonable efforts to notify customers of planned maintenance and address unplanned incidents. Any service credits are subject to the disclosed SLA and mandatory law; a credit remedy does not waive non-waivable legal claims.
Unless managed security has expressly been purchased, customers should reasonably secure their systems, firewall rules, credentials, and applications, while FiHosts remains responsible for its committed infrastructure services.
07 Accounts and Security
Customers must safeguard passwords, SSH keys, and multi-factor authentication credentials and promptly report suspected unauthorized access. FiHosts may use CAPTCHA, anti-abuse controls, and proportionate identity checks to secure accounts.
Any identity verification or risk screening must collect only data reasonably necessary for legitimate and disclosed purposes and be handled under applicable privacy obligations.
Temporary account restrictions may be imposed for credible account compromise, fraud, or security risks, with an appropriate review and recovery process.
08 Privacy, Backups, and Data Deletion
Customers are generally responsible for the data they store or process and should implement independent, tested backups. Separately purchased managed backup services are governed by their specific commitments.
FiHosts must separately publish a privacy notice explaining account, log, payment, and support-data processing, including purposes, categories, retention, locations, recipients, and individual rights. The PRC Personal Information Protection Law and applicable U.S. federal and state rules may apply depending on the activities involved.
Cross-border transfers, subprocessors, and overseas handling of personal information require an analysis of actual data flows and applicable disclosure, assessment, contractual, or other legal requirements. These Terms are not blanket consent to all international transfers.
Retention, export windows, and deletion after termination should be disclosed in the relevant product policy, subject to lawful preservation duties. Data must not be erased contrary to applicable contractual or legal retention obligations.
09 Intellectual Property and Copyright Notices
Customers must hold the rights or licenses necessary to operate their applications and distribute their content. Claimants may send a report identifying the protected work, allegedly infringing material, location, contact information, and basis of ownership via a FiHosts support ticket.
FiHosts will assess reports in a reasonable manner, act as required by applicable law, notify affected customers when appropriate, and provide legally applicable objection or counter-notice processes. Knowingly false allegations may incur legal consequences.
For U.S. DMCA section 512 safe-harbor eligibility where applicable, a qualifying online service provider may need to register a designated agent with the U.S. Copyright Office and publish the agent's contact details. These Terms do not claim that FiHosts has completed that registration or automatically qualifies for immunity.
10 Local Laws, Sanctions, and Regulatory Matters
The parties must comply with laws applicable to their actual conduct, service location, contracting entity, and markets served, including cybersecurity, privacy, IP, consumer protection, and any required regulatory licenses or registrations.
To the extent transactions are subject to applicable U.S. export controls or economic sanctions, the parties must comply with those restrictions. Screening and refusals should be based on genuine applicable obligations, not overbroad assumed prohibitions.
Customers remain responsible for applicable content, security, and local registration requirements for their own operations. FiHosts should not claim to hold specific PRC telecom licenses or U.S. approvals without verification.
11 Suspension, Termination, and Restoration
FiHosts may proportionately suspend or terminate service for serious unlawful abuse, substantial security threats, prolonged unpaid obligations, or other material breaches under the lawful agreement. Advance notice and a reasonable opportunity to cure should be given when practicable, except in emergencies or where law prevents notice.
When a breach is cured or a report is found unfounded, FiHosts should reasonably review restoration. Prepayments, account balances, and post-termination data remain subject to the order and applicable law.
An unexplained 'sole and final interpretation' statement cannot remove customers' lawful complaint processes or statutory remedies.
12 Responsibility, Force Majeure, and Mandatory Rights
Each party remains responsible for its breaches, intentional misconduct, gross negligence, and other liabilities imposed by law. No limitation excludes liabilities that applicable law does not permit to be excluded, including certain personal injuries and intentional or grossly negligent property damage.
A party affected by force majeure should provide legally required notice and take reasonable steps to mitigate harm. Consequences depend on the facts, applicable law, and the affected contractual obligations; force majeure is not an automatic waiver of every charge or duty.
A separately agreed SLA, data processing agreement, or product-specific schedule governs its specific subject matter without removing mandatory customer protections.
13 Complaints, Disputes, and Applicable Law
Customers can raise billing, refund, uptime, or abuse-handling concerns through the FiHosts support portal. FiHosts should offer accessible channels and reasonable responses.
Contracting entity location, governing law, and any applicable competent court or arbitration mechanism: [TO BE VERIFIED FOR ENTITY AND TARGET MARKETS]. Pending confirmation, these Terms do not purport to waive mandatory consumer jurisdiction, complaint rights, or statutory remedies.
Consumers in mainland China or various U.S. states may hold protections that cannot be waived by contract. Mandatory law prevails in the event of conflict.
14 Amendments and Effective Date
FiHosts should give reasonable advance notice of material Terms changes and identify the version and effective date. Material amendments affecting price, refunds, renewal, or data should not retroactively deprive customers of vested rights under existing orders.
Whether continued use constitutes acceptance depends on the actual notice and consent process and applicable law; simply posting revised terms does not automatically establish universal acceptance.
Draft version: v1.0 (2026-10-10); legal effective date: [TO BE CONFIRMED]. In case of differences between languages, interpret the terms by the disclosures actually provided, reasonable customer understanding, and applicable law, without unilaterally depriving users of mandatory rights.
15 Contact Information
Website: fihosts.com. Customer and billing support: please open a ticket via the client portal. Legal notices, privacy contact, and registered address: [TO BE CONFIRMED BEFORE PUBLICATION].
Placeholder contact details in this draft are not verified entity disclosures. If a dedicated abuse or copyright email is used, it must be added before publication and tested for deliverability.
Privacy Policy
Personal data handling notice (pending legal and operational review)
01 Controller and Contact Information
Legal-review draft; not effective. This notice is intended for FiHosts. Before publication, disclose the contracting entity and data controller's legal name, registered address, privacy contact email, applicable jurisdiction, and any required local representative. These details have not been confirmed.
For now, users can raise account security or data-access questions through the FiHosts support center. The final notice must specify an accessible dedicated privacy contact method.
02 Information and Purposes
Depending on the service requested, registration, email verification, account support, orders, invoices, fraud prevention, and delivery may involve contact details, billing address, company details, service selections, transaction references, ticket messages, IP addresses, timestamps, browser/device metadata, and security logs. The final notice must match data actually collected; this draft does not authorize additional collection.
Contact details help us administer accounts and send notices; billing records support transactions and legal recordkeeping; technical logs support security and abuse prevention. Any sensitive data must be assessed separately for necessity and applicable notice or consent requirements.
03 Cookies and Anti-Bot Checks
The website may rely on session and security cookies, anti-CSRF protections, language preferences, and hCaptcha for bot mitigation. hCaptcha may process relevant request and device signals under its own disclosures. Any optional analytics, advertising or marketing cookies, their providers, and consent choices must be disclosed based on actual deployment.
04 Service Providers and Disclosures
Service fulfillment may involve data centers, domain registrars, invoicing and helpdesk platforms, mail delivery services, payment processors, fraud and security providers. The final notice must identify relevant recipients or categories, purposes, data types, roles, and locations. Sharing for service fulfillment does not automatically mean selling personal information.
Domain registration may require providing specified registrant details under applicable registry rules. Full payment card numbers and verification codes should ordinarily be handled by properly authorized payment processors, not unnecessarily retained by FiHosts.
05 International Transfers
Hosting, support, and security operations may involve processing across borders. Before publication, specify actual recipient locations or categories, purposes, categories of personal data, and appropriate legal transfer mechanisms. Where the Chinese Personal Information Protection Law applies, assess separate consent, impact assessment, and any other mandatory mechanisms where required. A generic notice alone does not replace them.
06 Retention, Deletion, and Security
Retention periods are not yet confirmed. The final notice must state category-level periods or defensible criteria, including legal reasons to retain billing, tax or security records. Information should be deleted or de-identified when no longer required, subject to law. Appropriate safeguards may include access controls and logging, but no service can promise absolute security.
07 Privacy Rights and Choices
Subject to applicable law and exceptions, you may request access, correction, deletion, a copy of information, restriction or objection to certain processing, withdrawal of consent, and applicable US state-specific privacy choices. The final policy must provide instructions, identity checks, response times, appeals options, and information about legally permitted exceptions. Users should not be unlawfully discriminated against for exercising rights.
08 Children, Changes, and Contact
FiHosts hosting services are intended for customers legally able to contract for them. Information about children will be handled as required by applicable law. Material privacy changes will be communicated as appropriate, and any new consent will be obtained where required. This draft requires operational verification of identity, vendors, data inventory, retention, transfers, and rights processes before publication.
